Terms of Use
These Terms of Service ("Terms") govern your access to and use of the Cracy platform, including all mobile applications, websites, software, features, content formats, campaigns, voting mechanisms, communities, messaging systems, APIs, and related services (collectively, the "Platform").
By accessing or using Cracy, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree, you must not access or use the Platform.
1. Nature of the Platform (Read Carefully)
Cracy is a neutral technology platform and intermediary that enables users to create, publish, discover, interact with, and campaign for content created by other users.
Cracy:
- Does not create, initiate, endorse, verify, guarantee, or moderate content prior to publication
- Does not act as a publisher, editor, broadcaster, fiduciary, agent, or representative of any user
- Does not guarantee reach, visibility, engagement, influence, rankings, or outcomes
All content, campaigns, votes, communications, and interactions originate exclusively from users.
2. Eligibility and Account Responsibility
You may use Cracy only if:
- You are legally capable of entering into a binding contract
- You comply with applicable laws in your jurisdiction
- You are not prohibited from using the Platform under any applicable law
You are solely responsible for:
- Maintaining the confidentiality of your credentials
- All activity conducted through your account
- Ensuring that your use of Cracy complies with these Terms
Cracy bears no responsibility for unauthorized access caused by user negligence.
3. User Content and Absolute Responsibility
3.1 Ownership and Control
You retain ownership of content you create. However, by uploading or sharing content on Cracy, you represent and warrant that:
- You have all necessary rights, consents, and authority
- Your content does not violate any law or third-party right
3.2 License to Cracy
You grant Cracy a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to host, store, reproduce, distribute, modify, display, and process your content solely for the purpose of operating, improving, securing, and promoting the Platform.
3.3 Absolute User Liability
You are solely and entirely responsible for:
- Content you upload or share
- Campaigns you initiate or participate in
- Votes you cast or solicit
- Any consequences arising from visibility, interpretation, or redistribution of your content
Cracy assumes zero liability for user-generated content.
4. Campaigns, Voting, and Influence Mechanics
Campaigns, votes, rankings, and influence metrics are:
- Algorithmic, dynamic, and non-deterministic
- Subject to change, fluctuation, or removal
- Provided "as-is" and "as-available"
Cracy:
- Makes no representations regarding fairness, accuracy, or outcomes
- Does not guarantee neutrality, reach, or performance
- Is not liable for perceived bias, loss, or disadvantage
Participation is entirely at your own risk.
5. Prohibited Conduct (Non-Exhaustive)
You agree not to:
- Upload unlawful, misleading, or infringing content
- Violate privacy, publicity, or data protection rights
- Manipulate campaigns, votes, or metrics
- Scrape, reverse-engineer, or exploit the Platform
- Use Cracy for harassment, coercion, or harm
Cracy may take action at its sole discretion, without obligation to provide notice or justification.
5A. User Conduct and Content Restrictions
Users must not create, upload, post, or share content that:
- Is abusive, threatening, or promotes violence
- Contains hate speech, discrimination, or harassment
- Is sexually explicit or inappropriate
- Is illegal or violates any applicable laws
- Infringes intellectual property rights
- Contains spam, scams, or misleading information
Cracy has ZERO TOLERANCE for objectionable content or abusive users.
We reserve the right to:
- Remove any content that violates these rules
- Suspend or permanently ban accounts
- Take action without prior notice if necessary to protect users and the platform
Users can report content or accounts that violate these guidelines through in-app reporting tools.
Users can also block other users to prevent unwanted interactions.
6. Moderation, Enforcement, and Discretion
Cracy actively monitors, reviews, and enforces strict policies against objectionable content and abusive behavior.
Cracy may (but is not obligated to):
- Remove or restrict content
- Suspend or terminate accounts
- Limit reach, visibility, or features
All enforcement actions are:
- Discretionary
- Non-precedential
- Taken without assumption of duty or liability
Failure to act does not constitute waiver or endorsement.
7. Third-Party Services and Links
Cracy may integrate or link to third-party services. Cracy:
- Does not control or endorse third-party content or practices
- Is not responsible for third-party actions or omissions
Your interactions with third parties are solely between you and them.
8. Suspension and Termination
Cracy may suspend or terminate access:
- At any time
- For any reason or no reason
- With or without notice
Cracy shall not be liable for any resulting loss, data deletion, or reputational harm.
9. Disclaimers
The Platform is provided "AS IS" and "AS AVAILABLE".
Cracy expressly disclaims:
- All warranties, express or implied
- Accuracy, reliability, or suitability
- Continuous or error-free operation
Use of the Platform is entirely at your own risk.
10. Limitation of Liability (Maximum Protection)
To the maximum extent permitted by law:
- Cracy shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages
- Cracy shall not be liable for loss of data, profits, goodwill, reputation, or opportunity
- Cracy's total liability, if any, shall not exceed the minimum amount required by law
Users expressly waive all claims beyond this limitation.
11. Indemnification
You agree to fully indemnify, defend, and hold harmless Cracy, its founders, directors, employees, and partners from any claims, losses, damages, or expenses arising from:
- Your content
- Your use of the Platform
- Your violation of these Terms or any law
12. Intermediary Status & Safe Harbour Protection (Global)
Cracy operates as a neutral technology intermediary and service provider under applicable laws across jurisdictions.
Cracy:
- Does not initiate user transmissions
- Does not select or control recipients
- Does not create, alter, or meaningfully modify user-generated content
Any hosting, caching, transmission, ranking, recommendation, or display of content is performed through automated technical processes or neutral system operations.
Cracy retains all safe-harbour, intermediary, conduit, hosting, or service-provider protections available under applicable laws worldwide, including their equivalents across different jurisdictions.
Safe-harbour protections apply to the maximum extent permitted by law, regardless of whether Cracy exercises discretionary moderation, enforcement, or platform governance functions.
Nothing in these Terms shall be construed as creating a duty to monitor, pre-screen, verify, or police user content.
13. Governing Law, Jurisdiction, and Global Use
Cracy operates as a global technology platform, accessible across multiple jurisdictions.
To the maximum extent permitted by applicable law:
- Cracy does not submit to the exclusive jurisdiction of any country, state, or territory solely due to the availability or accessibility of the Platform
- Users access and use the Platform at their own initiative and risk
- Users are solely responsible for compliance with any local, national, or international laws that may apply to their use of the Platform
- Nothing in these Terms shall be interpreted as Cracy purposefully directing, targeting, or availing itself of any specific jurisdiction
Where governing law or jurisdiction cannot be contractually excluded under mandatory law, such law shall apply only to the minimum extent required, and solely for the purpose of resolving the specific issue that cannot be waived.
Under no circumstances shall any such mandatory application be construed to expand Cracy's duties, obligations, or liability beyond what is strictly required by law.
14. Updates to These Terms
Cracy reserves the unconditional right to update or modify these Terms at any time. Continued use after changes constitutes acceptance.
15. Severability and Interpretation
If any provision is held unenforceable, remaining provisions shall continue in full force.
These Terms shall be interpreted:
- Together with the Privacy Policy and other Cracy policies
- In favor of platform neutrality and liability limitation
16. Final Acknowledgement
By using Cracy, you acknowledge that:
- You understand the risks of public platforms
- You assume full responsibility for your actions
- You release Cracy from liability to the maximum extent permitted by law
If you do not agree, you must discontinue use immediately.
